Philips and Sony have teamed up to develop a DRM solution that is open, according to this Wired article.
What they want is a DRM system that works across many platforms and will be supported by many consumer electronics makers and content providers.
They bought Intertrust "to make sure that key DRM patents are available to everyone in the industry".
That is one way to work around the failure of the patent system. And maybe the easiest way as long as software patents are still not abolished altogether.
